These Terms of Service (“Terms”) govern your use of In-Element: Balance (the “App”), operated by Inner Element, LLC (“we,” “us”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The App offers wellness-oriented experiences (for example, elemental profiles, suggested content such as foods or movement ideas, music, partner discovery, and optional AI-assisted features).
The App is for general wellness and entertainment only. It is not medical, nutritional, or exercise advice, and it is not a substitute for professional care. Suggestions (including around food or physical activity) are informational. You are solely responsible for deciding what is safe and appropriate for you. Consult a qualified professional before changing diet, exercise, or health routines, especially if you have a medical condition, injury, allergy, or are pregnant.
You must be able to form a binding contract where you live and must meet the minimum age in our Privacy Policy (not intended for children under 13). If you use the App on behalf of an organization, you represent that you have authority to bind it.
Keep your login credentials confidential. You are responsible for activity under your account. Notify us if you suspect unauthorized access.

The App and its content (excluding your account information and content you provide) are owned by us or our licensors. Icons and other third-party materials may be subject to separate licenses (see the Privacy Policy, Icon credits).
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we and our affiliates, officers, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App or reliance on any suggestion in the App—including food or exercise guidance—even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for claims arising from these Terms or the App is limited to the greater of USD $50 or the amount you paid us for the App in the twelve (12) months before the claim (if any).
You will defend and indemnify us against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms, to the extent permitted by law.
We may modify these Terms. We will post the updated Terms with a new effective date. Continued use after changes constitutes acceptance unless applicable law requires otherwise.
These Terms are governed by the laws of the United States and the state where Inner Element, LLC is organized, excluding conflict-of-law rules. If a provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver.
