1. Introduction

Inner Element, LLC (“we,” “us”) operates In-Element: Balance (the “App”). This Privacy Policy describes how we collect, use, and share information when you use the App. By using the App, you agree to this Policy. If you do not agree, please do not use the App.

The App offers wellness-oriented experiences (for example, elemental profiles, suggested content, music, partner discovery, and optional AI-assisted features). The App is for general wellness and entertainment and is not medical advice, diagnosis, or treatment. We are not a medical provider and users should not rely on the App for medical advice. Users agree that any actions taken as a result of suggestions in the App are at their own risk and we are not liable for any damages, losses, or injuries resulting from such actions.

2. Information we collect

A. Information you provide for an account.

Account credentials — If you create an account with email and password, we process your email address and authentication credentials through our authentication provider (see Section 5).
Profile and app content — Information you enter in the App (for example, quiz responses, preferences, saved history, or similar) may be stored in our database associated with your account.

B. Information collected automatically

Identifiers & technical data — Such as a mobile advertising identifier only if used by the platform or SDKs you integrate; device type; operating system version; app version; and general diagnostic information you choose to log (for example, error reports you send).
Usage data — Interactions needed to operate features (for example, opening partner links, playback-related events for music features, and similar app events as implemented in the App).

C. Information from third-party content

Partners & external links — When you open a partner or external schedule link, that site’s privacy practices apply (we do not control third-party sites).
Music & media — Metadata or playback-related events may be processed as needed to operate listening features and any royalty or reporting features described in the App.

D. Play Store test signups (marketing website)

If you submit your email on our website to request access to Google Play closed testing, we store that email address, your consent, and basic technical information (such as browser user-agent) in our backend (Firebase) so we can add you as a tester in Google Play and contact you about the test. We use this list only to operate the test program unless we separately ask for broader marketing consent.

3. How we use information

We use information to:

Provide, maintain, and improve the App;
Personalize your experience (for example, results and suggestions);
Operate music and partner features, including integrity, rate limiting, and reporting as implemented;
Provide optional AI-generated content (for example, recipes, movement suggestions, or affirmations) through our backend services;
Communicate with you about support requests you send to support@in-element.com;
Invite you to Google Play closed testing when you request access on our website;
Protect security, enforce our terms, and comply with law.

We do not sell your personal information as a standalone product. We do not use third-party advertising or analytics SDKs in the App at this time; if that changes, we will update this Policy.

4. AI-generated content

Some features may generate text or suggestions using automated systems. Outputs may be inaccurate or incomplete. Do not rely on them for medical decisions. You are responsible for how you use generated content.

5. Service providers (including Firebase / Google)

We use Google Firebase and related services (for example, Authentication, Cloud Firestore, Cloud Functions, Cloud Storage where used) to host accounts, store data, and run backend logic. Google processes data according to its terms and privacy policy:

We may use additional subprocessors as our services evolve; we will update this Policy when we add material new processing.

6. Sharing of information

We may share information:

With service providers who help us run the App (e.g., hosting and infrastructure), subject to contractual protections;
When required by law, legal process, or to protect rights, safety, and security;
In a business transfer (e.g., merger or acquisition), with notice as required by law.

We do not share your information with unrelated third parties for their own marketing unless we describe that here and obtain consent where required.

7. Data retention

We retain information as long as needed to provide the App and for legitimate business purposes (for example, security and legal compliance), unless a longer period is required by law. You may request deletion as described below; some information may persist in backups for a limited period.

8. Security

We use reasonable technical and organizational measures to protect information. No method of transmission or storage is 100% secure.

9. Your choices and rights

Depending on where you live, you may have rights to access, correct, delete, or export certain information, or to object or restrict certain processing.

You can delete your account and associated data we hold for that account directly in the App: from the Presence home screen, tap Delete account and confirm. You can also request help with deletion by contacting us at the email below.

To exercise these rights, contact support@in-element.com. We may need to verify your request. If you are in the EEA/UK, you may also lodge a complaint with your local data protection authority.

California residents: You may have additional rights under the CCPA/CPRA. We do not sell or share personal information as those terms are defined under California law as described in this Policy at this time.

10. Children

The App is not intended for children under 13 (or the age required in your jurisdiction). We do not knowingly collect personal information from children. If you believe we have, contact us and we will delete it.

11. International users

If you use the App from outside the United States, your information may be processed in the United States and other countries where we or our providers operate.

12. Changes

We may update this Policy from time to time. We will post the updated Policy with a new effective date and, where appropriate, provide additional notice.
